Due to the nature of our products we require all visitors to our store to carefully read and agree to the following terms. WE DO NOT SHIP ANY ITEMS TO THE FOLLOWING STATES: AZ, CA, CT, DE, GA, MA, MD, ME, MN, NJ, NY, OH, OR, RI, VT. All orders from these states are automatically deleted from our system. In consideration of the sale to me of the following fireworks ("these fireworks" herein) by ACME DISCOUNT FIREWORKS ("seller herein"), I hereby state under the penalty of perjury and represent and agree with the seller as follows: 1. I am over the age of eighteen years, and I assume full responsibility for any and all risks associated with the possession, handling, transportation, storing , using and selling ("handling and use" herein) of these fireworks. 2. I am purchasing these fireworks for and shall be fully responsible for exporting these fireworks from Idaho in a manner which complies with and does not violate the Idaho Fireworks Act of 1997. I will transport or provide for shipping of these fireworks to the city and state of destination set forth with my address information contained in the online store shopping cart. I will not permit others to do any handling and use of these fireworks within Idaho. My handling and use of, and the handling and use of these fireworks by others with my permission outside of Idaho shall be in full compliance with all applicable local, state, and federal laws, ordinances and regulations governing the use of these fireworks ("applicable laws" herein) at such place and use outside of Idaho. 3. The seller shall have no responsibility and no liability for violation of the Idaho Fireworks Act of 1997 and the applicable laws relating to my shipping and handling and use of these fireworks. It is my responsibility to and I shall obtain all permits of every kind required by all applicable laws relating to the shipping, handling and use of these fireworks. 4. I hereby indemnify and agree to hold the seller absolutely harmless from all claims, liabilities and damages including costs and reasonable attorney fees incurred by the seller as a result of my purchasing, shipping, handling and use of these fireworks. 5. In the event that that an item is out of stock I agree to accept a similar item of equal or greater value. 6. Shipping time is approx 14-20 working days from time of order. 7. I will not order items that are not approved for handling and use at the location I specify for shipment.
